It shall be understood that at the time of sale/placement, this Maltese puppy/dog is not considered to be of show or breeding quality. However, it is understood that the puppy/dog is a good representative of the Maltese breed, and structurally and temperamentally suited as a companion and/or obedience dog.

The above named puppy/dog is guaranteed for 7 days to be free of any health problems; however, it is recommended the buyer have the puppy/dog examined by a veterinarian during the first 7 days of ownership. Should the result of this veterinary examination determine the puppy/dog to have any health problems, Foxstone Maltese will refund 100% of the purchase price to the buyer upon return of the puppy/dog to Foxstone Maltese.

During the first 30 days of ownership, should the buyer become dissatisfied with the puppy/dog for any reason, Foxstone Maltese will refund 100% of the purchase price to the buyer. Foxstone Maltese reserves the right to deduct any and all veterinary expenses incurred by Foxstone Maltese from this refund if and when said expenses are determined to have been caused by the buyer.

The BUYER agrees that neither he/she nor the BUYER'S estate/executors may sell this PUPPY or transfer ownership of this PUPPY without the BREEDER'S knowledge and written consent. The BUYER also hereby agrees that if at any time the Buyer cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY. The BUYER agrees to notify the BREEDER of any changes of address during the PUPPY'S lifetime.

By signing this contract, the buyer agrees to never release the Maltese puppy/dog to any animal shelter, dog pound, or research facility. The purchaser agrees that should the occasion arise whereby the buyer no longer desires ownership of the puppy/dog, the puppy/dog will be returned to Foxstone Maltese.

Any reimbursement of fees for the medical condition of Luxating Patellas shall become null and void if the puppy/dog is allowed to jump on and off of furniture and/or run stairs.

Foxstone Maltese also guarantees the above named puppy/dog to be free of any and all life threatening hereditary defects, or any hereditary defects, which cause the puppy/dog to be unfit as a pet to the buyer. This guarantee shall apply for a period of 24 months (2 years) from the date of purchase. A certified veterinarian must verify, in writing, any such claim of hereditary defects. There is no other guarantee, either written or implied, other than the guarantees defined in this contract.

Applicable ____ Not Applicable____ In the event of such an occurrence as described above, Foxstone Maltese will replace the puppy/dog, at no cost to the buyer (excepting shipping costs) within 12 months from the date of the certified veterinarian's verification.

By signing this contract, the buyer agrees that this puppy/dog will not under any circumstances, be used for breeding purposes. The buyer further agrees that the puppy/dog will be spayed or neutered by a licensed veterinarian prior to the puppy/dog reaching 12 months of age. The buyer also agrees to provide Foxstone Maltese with written verification from a certified veterinarian that the spay/neuter procedure has been completed. AKC Registration papers will not be provided to the buyer until Foxstone Maltese has received such written notification from the certified veterinarian.

This agreement shall be governed by the laws of the State of Colorado to the exclusion of any other forum and constitutes the entire agreement between the parties signing below. This contract is a legal document, and by signing below, all parties agree to the terms and provisions contained herein.
